These Terms aim to stipulate matters concerning the terms and procedures for using all services (hereinafter "Services") provided by Cera Dental Clinic (hereinafter "the Clinic") on its website.
Terms of Service
Chapter 1: General Provisions
Article 1 (Purpose)
Article 2 (Definitions)
Terms used in these Terms are defined as follows:
- User: A person who receives services provided by the Clinic according to these Terms
- Service Agreement: An agreement concluded between the Clinic and users regarding service use
- Registration: The act of completing a service agreement by filling in required information in the application form provided by the Clinic and agreeing to these Terms
- Member: A person who has registered as a member by providing personal information required for membership registration on this site
- User ID: A combination of letters and numbers selected by the user and approved by the Clinic for member identification and service use (one ID per resident registration number)
- Password: A combination of letters, numbers, and special characters set by the user to protect their information
- Service Termination: Expression of intent by the Clinic or member to terminate the service agreement after service use
Article 3 (Effect and Modification of Terms)
Members may request membership withdrawal if they do not agree to the modified terms, and if they continue to use the service without expressing rejection after 7 days from the effective date of the modified terms, they are deemed to have agreed to the changes
① These Terms take effect by being posted on the service screen or announced through the notice board or other methods.
② The Clinic may modify these Terms when deemed necessary, and modified terms will be announced on the service screen. If no rejection is expressed after 7 days from the announcement and service use continues, agreement to the term changes is assumed.
③ Users who do not agree to the modified terms may stop using the service and cancel their membership registration. Continued use is deemed as agreement to the modified terms, which take effect through the method specified in the previous paragraph.
Article 4 (Applicable Regulations)
Matters not specified in these Terms shall be governed by the Basic Telecommunications Act, Telecommunications Business Act, and other relevant laws.
Chapter 2: Service Agreement
Article 5 (Establishment of Service Agreement)
The service agreement is established through the Clinic's acceptance of the user's application and the user's agreement to the terms.
Article 6 (Service Application)
Service application can be made by recording personal information in the registration application form required by the Clinic on the service's member information screen.
Article 7 (Acceptance of Service Application)
① If a member accurately completes all items in the application form when applying for service use, the service application will be accepted unless there are special circumstances.
② Service acceptance may be denied in the following cases:
- When not applying under real name
- When applying using another person's name
- When application content is falsified
- When applying with the purpose of disturbing social order or public morals
- When application requirements established by the Clinic are not met
Article 8 (Modification of Contract Details)
Members must modify information if items recorded during application have changed, and responsibility for problems arising from failure to modify lies with the member.
Chapter 3: Obligations of Contracting Parties
Article 9 (Clinic Obligations)
The Clinic will not disclose or distribute members' personal information known in relation to service provision to third parties without consent. However, this does not apply when requested by government agencies according to Basic Telecommunications Act and other legal provisions, for criminal investigation purposes, or upon request through procedures specified in relevant laws.
Article 10 (Member Obligations)
① Members must not engage in the following acts when using services:
- Unauthorized use of other members' IDs
- Copying, publishing, or providing information obtained from services to third parties
- Infringing on the Clinic's copyrights, third-party copyrights, or other rights
- Distributing content violating public order and morals
- Acts objectively judged to be connected to crime
- Acts violating relevant laws
② Members cannot use services for business activities, and the Clinic is not responsible for results arising from use for business activities.
③ Members cannot transfer or gift service use rights or other contractual positions to others, nor provide them as collateral.
Chapter 4: Service Use
Article 11 (Member Obligations)
① Members have management responsibility for maintenance of their mail, bulletin boards, registered materials, etc., as needed.
② Members cannot arbitrarily delete or modify materials provided by the Clinic.
③ Members must not register content violating public order and morals or content infringing third-party copyrights and other rights on the Clinic's website. All responsibility for results arising from posting such content lies with the member.
Article 12 (Post Management and Deletion)
For efficient service operation, memory space, message size, retention days, etc., may be limited, and registration content falling under the following cases may be deleted without prior notice:
- Content slandering or defaming other members or third parties
- Content violating public order and morals
- Content deemed connected to criminal acts
- Content infringing the Clinic's copyrights, third-party copyrights, or other rights
- Members posting pornographic material or linking to pornographic sites on the Clinic's website and bulletin boards
- Content deemed to violate relevant laws
Article 13 (Copyright of Posts)
Copyright of posts belongs to the poster, and members cannot commercially use materials posted on services for processing, sales, etc.
Article 14 (Service Hours)
Service use is in principle 24 hours a day, year-round, unless there are special business or technical problems. However, this does not apply during regular maintenance, etc.
Article 15 (Service Use Responsibility)
Service must not be used for hacking, linking to pornographic sites, illegal distribution of commercial software, etc., and the Clinic is not responsible for business activity results and losses, legal actions by relevant agencies, etc., arising from violations.
Article 16 (Service Provision Suspension)
Service provision may be suspended in the following cases:
- Unavoidable cases due to service facility maintenance, etc.
- When basic telecommunications operators stipulated in the Telecommunications Business Act suspend telecommunications services
- When system inspection is necessary
- Other force majeure circumstances
Chapter 5: Contract Termination and Use Restrictions
Article 17 (Contract Termination and Use Restrictions)
① When members wish to terminate the service agreement, they must apply for termination through the internet, and the Clinic will take action after confirming identity.
② The Clinic must notify users of termination at least 30 days in advance and give them an opportunity to state their opinions when members engage in the following acts:
- Stealing another person's user ID and password
- Intentionally interfering with service operation
- Applying for registration with false information
- The same user registering with different IDs
- Distributing content harmful to public order and morals
- Damaging others' reputation or causing disadvantage
- Transmitting large amounts of information or advertising information for the purpose of disturbing stable service operation
- Distributing computer virus programs that cause malfunction of information and communication facilities or destruction of information
- Infringing intellectual property rights of the Clinic, other members, or third parties
- Unauthorized use of others' personal information, user IDs, and passwords
- Members posting pornographic material or linking to pornographic sites on their homepage or bulletin board
- Cases deemed to violate relevant laws
Chapter 6: Other Provisions
Article 18 (Transfer Prohibition)
Members cannot transfer or gift service use rights or other contractual positions to others, nor provide them as collateral.
Article 19 (Damages)
The Clinic shall not be liable for any damages to members in relation to services provided free of charge, except for damages caused by the Clinic's intentional or gross negligence.
Article 20 (Disclaimer)
① The Clinic is exempt from liability for service provision in cases where services cannot be provided due to natural disasters, war, or other equivalent force majeure.
② The Clinic is exempt from liability for damages caused by unavoidable reasons such as service facility maintenance, replacement, regular inspection, or construction.
③ The Clinic is not liable for service use disruptions due to members' fault.
④ The Clinic is not liable for expected profits from service use or damages from materials obtained through services.
⑤ The Clinic is not liable for reliability, accuracy, etc., of information, materials, and facts posted by members on services.
Article 21 (Jurisdiction)
If litigation arises from disputes related to service use, the court having jurisdiction over the Clinic's location shall be the exclusive jurisdiction court.
These Terms are effective from January 1, 2023.
